1. Acceptance of Terms

By accessing or using the BabyReel application ("Service"), you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these terms, you should not use the Service.

BabyReel is a digital diary application for recording moments of pregnancy, baby development, and pets, allowing the creation of photos, milestones, videos, and memories.

2. Eligibility

You must be at least 18 years old to use the Service. By registering, you represent and warrant that you have the legal capacity to enter into this agreement.

3. User Account

To access certain features, you must create an account by providing truthful and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.

You must notify us immediately of any unauthorized use of your account.

4. Plans and Payments

BabyReel offers a free plan with limited features and paid plans with additional resources. Paid plans are offered as a one-time payment (lifetime), with no recurring charges.

• Free Plan: 1 journey, 500MB of storage, 1 video with watermark.
• Single Journey: 1 journey, 2GB of storage, 5 videos without watermark.
• Full Childhood: 4 journeys, 5GB of storage, 20 videos without watermark.
• Family Premium: 10 journeys, 15GB of storage, 50 videos without watermark.

Payments are processed through third parties (Stripe). BabyReel does not store credit card data directly.

5. Refund Policy

If you are not satisfied with the Service, you may request a full refund within 7 (seven) calendar days from the date of purchase, in accordance with applicable consumer protection laws. After this period, no refunds will be granted.

In the event of a refund, your plan will be reverted to the free plan and additional resources will be deactivated.

6. User Content

You retain all rights to the photos, videos, and texts you submit to the Service ("User Content"). By submitting content, you grant us a limited, non-exclusive, and revocable license to store, process, and display such content solely for the operation of the Service.

You are entirely responsible for the content you submit and represent that you hold the necessary rights to all shared material. It is prohibited to submit illegal, offensive content, content that violates third-party rights, or content that contains harmful material.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to access other users' accounts without authorization
• Reverse engineer, decompile, or disassemble any part of the Service
• Submit content containing viruses, malware, or malicious code
• Use the Service to distribute spam or unsolicited commercial content
• Intentionally overload the Service's infrastructure

8. Intellectual Property

BabyReel, including its design, logos, source code, texts, and other elements, is protected by intellectual property laws. You do not acquire any ownership rights over the Service, except the limited right to use it in accordance with these Terms.

9. Third-Party Services

BabyReel uses third-party services for its operation, including but not limited to:

• Supabase: Authentication and database
• Cloudflare R2: Photo and video storage
• Remotion: Video generation
• Stripe: Payment processing
• Google: Social authentication (Sign in with Google)

The use of these services is subject to the respective privacy policies and terms of use of each provider.

10. Service Availability

We will strive to keep the Service continuously available, but we do not guarantee that it will always be accessible, error-free, or uninterrupted. We may perform maintenance, updates, or modifications without prior notice.

11. Limitation of Liability

To the maximum extent permitted by law, BabyReel and its creators shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including data loss, lost profits, or moral damages.

We recommend that you keep backup copies of your photos and important content on other services or devices.

12. Account Termination

You may request the termination of your account at any time. After termination, your data will be deleted from our servers within 30 (thirty) days, except when retention is required by law.

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

13. Changes to Terms

We may update these Terms periodically. Significant changes will be communicated through the Service or by email. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States of America. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction in accordance with applicable law.
